Separate engagement terms, fee agreements, regulatory disclosures, finance documents or lender terms may also apply to a particular transaction. Where separate terms have been expressly agreed in connection with our services, those terms will apply to the relevant service and will take priority to the extent of any inconsistency.

3. Our role

Four Commercial Finance provides commercial finance brokerage and related intermediary services. Unless expressly stated otherwise in writing in relation to a particular transaction, we act as a broker or intermediary and not as a lender. We may introduce customers to banks, alternative lenders, specialist funders and other finance providers. We do not represent that we have access to every finance provider or finance product available in the market, and our panel may change from time to time.

4. Regulated and unregulated finance

Commercial finance may include both regulated and unregulated products and activities. Whether a particular finance arrangement is regulated depends upon matters including the applicant, legal structure, purpose of the finance, nature of the transaction and applicable legislation. Where a service we provide is subject to Financial Conduct Authority requirements or other regulatory requirements, applicable disclosures and protections will be provided where required. You should not assume that a commercial finance product is regulated merely because Four Commercial Finance has arranged or introduced it.

5. No guarantee of finance

Submitting an enquiry or application does not guarantee that finance will be available. Finance is subject to the relevant provider's criteria and may be subject to application and underwriting, creditworthiness and affordability assessments, satisfactory identification checks, anti-money laundering checks, valuations, security requirements, legal due diligence, satisfactory documentation, availability of funds and final approval by the finance provider.

A decision in principle, indicative quotation, heads of terms or similar communication does not normally constitute an unconditional commitment to lend. Finance providers may amend or withdraw an offer before completion where permitted by their terms.

6. Information you provide

You agree that information you provide in connection with an enquiry or finance application will, to the best of your knowledge, be accurate, complete and not misleading, and you must promptly inform us if material information changes. You authorise us, where reasonably necessary to deal with your enquiry or application, to provide relevant information to potential finance providers and other parties involved in assessing or completing the proposed transaction, subject to applicable data protection law and our Privacy Policy. Providing inaccurate, incomplete or misleading information may result in delay, rejection or withdrawal of a finance offer.

7. Information about other people

If you provide information concerning another person, including a director, shareholder, beneficial owner, partner or guarantor, you confirm that you have an appropriate basis for providing that information. Where appropriate, you should make that individual aware that their information may be processed in connection with the proposed finance transaction.

8. Credit searches and due diligence

A finance provider may carry out searches or checks before deciding whether to provide finance:

  • credit-reference searches
  • identity checks
  • fraud-prevention checks
  • anti-money laundering checks
  • sanctions screening
  • Companies House searches
  • property or asset checks
  • other appropriate due diligence

Any credit search conducted by a lender or another third party will be governed by that organisation's procedures and privacy information.

9. Fees

Four Commercial Finance will clearly communicate any fee payable by you for our brokerage or related services where applicable. Where a customer fee applies, details including the amount or method of calculation, when it becomes payable and relevant refund provisions will be set out separately where required. You should read any fee agreement carefully before accepting it.

Unless expressly agreed otherwise, you remain responsible for third-party costs that you have agreed to incur in connection with a finance transaction, which may include valuation fees, legal fees, survey fees, due-diligence costs and finance-provider fees.

10. Commission and other remuneration

Four Commercial Finance may receive commission, fees or other remuneration from a lender, funder or other third party in connection with finance we arrange or introduce. The existence, nature and, where applicable, amount or method of calculating relevant remuneration will be disclosed where required by law or regulation. For regulated credit-broking transactions, additional commission disclosure requirements may apply. Where you are legally entitled to request information regarding commission received in connection with your transaction, we will provide the required information. The remuneration available to us may differ between finance providers.

11. Rates, payments and illustrations

Rates, fees, repayment amounts, loan-to-value figures, finance amounts and other figures displayed on our website or provided at an early stage are illustrative or indicative unless expressly stated otherwise. Actual terms are determined by the relevant finance provider following assessment of an application. Interest rates, fees and provider criteria can change. You should carefully review formal terms issued by the relevant finance provider before entering into a finance agreement.

12. Independent advice

Information on our website is intended as general information and does not constitute legal, tax, accounting or investment advice. The suitability and consequences of commercial finance depend upon individual circumstances. You should obtain independent professional advice where appropriate before entering into a transaction.

13. Security

Commercial finance may be secured against business assets, property or other assets. Depending upon the finance product, failure to maintain repayments may result in enforcement action and could put assets provided as security at risk. You should read all finance-provider documentation carefully and obtain independent professional advice where appropriate.

14. Introductions to third parties

We may introduce you to finance providers or other third parties whose products or services may be relevant to your requirements. Unless otherwise stated, those organisations are independent from Four Commercial Finance. We are not responsible for the acts, omissions, underwriting decisions, service performance or contractual obligations of an independent third party merely because we introduced you to them. Your contractual relationship with a finance provider will be governed by that provider's own agreement and terms.

15. Website information

We take reasonable care when preparing information published on our website. However, commercial finance markets, interest rates, lender criteria and regulations change frequently. We do not warrant that all website information will always be complete, current or appropriate to your particular circumstances. We may update, amend or remove website content without notice.

Subject to applicable law and any separate contractual or regulatory obligations owed by us, Four Commercial Finance will not be responsible for losses arising solely from a finance provider declining an application; a provider changing or withdrawing an indicative offer; changes to interest rates or lending criteria; delays caused by finance providers or other independent third parties; incomplete, inaccurate or misleading information supplied to us; failure to obtain appropriate professional advice; temporary website unavailability; or events outside our reasonable control. Nothing in these Terms limits statutory or regulatory rights that cannot lawfully be restricted.

22. Complaints

23. Changes to these Terms

We may update these Terms from time to time. Changes will take effect when revised Terms are published on our website unless otherwise stated. Terms separately agreed for an existing transaction will not be changed merely by updating these website Terms unless the applicable agreement permits such a change.

24. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary and the remaining provisions will continue in effect.

25. No waiver

If we delay or fail to exercise a right under these Terms, this does not mean that we have waived that right.

Our hosting provider describes this as App Usage Data and processes it on our behalf; according to our hosting provider's published privacy information, App Usage Data from customers' published applications is not used to train our hosting provider's AI models. Where a proposed finance provider requires a credit or fraud-prevention search, information about you or your business may be provided to the relevant organisation. Those organisations may retain records of searches and may link information relating to people who are financially associated. Where processing is undertaken directly by a finance provider, you should refer to that provider's privacy information.

10. International transfers

Some technology, hosting, finance or other service providers may process personal information outside the United Kingdom. Where information is transferred internationally, appropriate steps will be taken to ensure the transfer is lawful, which may include UK adequacy regulations, approved contractual safeguards or another lawful transfer mechanism.

11. How long we keep information

We may use the project analytics functionality provided by our hosting platform to understand how our published website is being used.
